Rental Agreement

These rental terms apply to direct booking requests and confirmed stays at the vacation home identified in the booking confirmation or rental agreement. They are provided here so guests can review the agreement before submitting a booking request.

For purposes of this page:

  • Host means Paradise Villas Vacation Rentals LLC.
  • Guest means the person submitting the booking request and, where applicable, the primary renter responsible for the stay.
  • Property means the specific vacation home identified in the booking confirmation or rental agreement.
  • Agreement means these rental terms together with the booking confirmation, payment terms, cancellation policy, fees, deposits, taxes, and any signed rental agreement or other written booking details provided by Host.

By submitting a reservation request, Guest acknowledges these terms. A reservation is not confirmed until accepted by Host in writing and, if requested by Host, signed by Guest. The effective date is the date the booking is confirmed by Host, and this Agreement applies to the specific stay dates, occupants, and charges reflected in the booking confirmation or rental agreement.

1. Booking, Rates, Taxes & Payments

Booking & Rates. Nightly rates, fees, and promotions are dynamic and kept up to date by Host. The total shown in the booking confirmation or rental agreement governs the price for the confirmed dates and number of guests and includes rent, mandatory fees, applicable taxes, and any refundable deposit if applicable.

Minimum Stay. 7-night (one-week) minimum; no exceptions without Host's written consent.

Taxes. Short-term rentals in Cape Coral are subject to 6.5% Florida sales tax + 5% Lee County Tourist Development Tax = 11.5% in total, added at booking.

Payments. Reservation charges are paid according to the payment instructions provided by Host. Host does not accept a reservation as confirmed until payment and any required documentation have been received and accepted by Host.

Security/Damage Deposit. If a refundable deposit is collected, the amount and handling will be shown in the booking confirmation or rental agreement. Deductions may be taken for damages, missing items, excessive cleaning, rule violations (including noise, occupancy, and unauthorized guests), unpaid utility overages, and other amounts due under this Agreement.

Cancellation & Refunds. The cancellation policy stated in the booking confirmation or rental agreement controls. Weather, including tropical storms or hurricanes, is not a basis for refund except as expressly provided under the applicable cancellation policy or required by law.

2. Occupancy, Use & Quiet Enjoyment

Whole-home rental. Guest is renting the entire home.

Maximum Occupancy. The property can accommodate up to 6 guests total, including children and infants. Number of guests specified at time of booking is binding and controls how many guests can stay during the rental period.

Guests/Visitors. All guests need to be registered at the time of booking. No additional or unregistered guests are allowed. Daytime visitors require prior written approval and must depart by quiet hours. No overnight visitors.

Minimum Renter Age. Primary Renter must be 28+ and present for the entire stay.

Children. The home is not equipped for small children (no child-specific safety measures). Supervision is required at all times around water, lanai, and dock.

Vehicles & Parking. Maximum 2 cars; no RVs, trailers, boats, jet skis, or commercial vehicles without prior written approval.

Events & Parties. Absolutely no parties or events of any kind, including bachelor/ette parties, receptions, or similar.

Smoking/Vaping. No smoking or vaping inside the house or garage. Evidence of smoking will incur additional cleaning and odor remediation fees.

Pets. No pets of any kind.

Freshwater Canal Disclosure. The property is on a freshwater canal (no Gulf access). Boat lift(s), if any, are not for guest use.

3. Utilities & Electricity Policy

Utilities Included. Water/sewer, trash, basic landscaping/pest service, and internet/Wi-Fi are included.

Electricity. Electricity is charged at 15¢ per kWh. If the booking includes a bundled electric fee, usage up to the fee amount is included; overages are charged to the Guest and may be deducted from the deposit and/or charged post-stay.

Meter Reads. Electric meter will be read at check-in and check-out to calculate total consumption for the stay.

High-Usage Advisory. The pool & spa are electrically heated and can consume substantial power. Running A/C with doors/windows open or at excessively low temperatures can cause high usage. Guest is responsible for all usage and any overage charges.

4. Pool, Spa, Dock & Outdoor Areas

Pool/Spa Use. Operate only per the provided guide. An app is available to manage the pool/spa automation during your stay.

Filtration Schedule. The pool filtration system must not be turned off during normal operation hours (10:00 AM - 5:00 PM).

Equipment Access. Guests are prohibited from touching or manipulating pool equipment (pump, filter, heater, automation panel, valves). Damages from improper use are the Guest's responsibility and may be deducted from the deposit and/or charged post-stay.

No Lifeguard. Use at your own risk. Children must be supervised at all times. No glass on the pool deck or dock.

Dock/Water Safety. Exercise caution near the canal and dock; do not dive or swim in the canal. Slippery surfaces may occur when wet.

5. Noise & Community Rules

Quiet Hours. 10:00 PM - 8:00 AM (strict). No loud music, shouting, or elevated voices, especially on the pool deck, lanai, dock, driveway, or entryway.

Nuisance. No nuisances or disturbances. Violations may result in immediate removal without refund and/or city fines charged to Guest.

6. Maintenance, Repairs & Emergencies

Standard Support Hours. 10:00 AM - 6:00 PM local time for routine matters (non-urgent).

Emergency Line. A separate emergency number will be provided for time-critical issues threatening safety or the property (e.g., active water leaks, electrical hazards). Non-emergency use is prohibited and may incur a call-out fee charged to Guest.

Access for Repairs. Guest agrees to provide reasonable access for repairs, service, or legally required inspections with notice.

7. Internet, TVs & Smart Devices

Internet. High-speed internet and Wi-Fi are provided as a convenience. Illegal activities (e.g., copyright infringement) are prohibited and may be reported to authorities.

Smart TVs/Systems. Do not alter system settings (admin menus, log-ins, parental controls). Tampering may incur service charges to restore.

8. BBQ Grill

Condition. Grill is provided clean and must be returned clean.

Cleaning Fee. A cleaning charge will be applied if the grill is left dirty.

Propane. Propane tank is provided as-is; Guest must replenish if it empties during the stay (exchange for a filled tank required).

9. Trash & Housekeeping

Trash Day. Tuesday pickup (place cans at curb Monday night). City schedules may change - observe posted instructions.

Check-out Trash. Empty all interior bins (kitchen, bedrooms, and bathrooms) into the exterior cans at check-out.

Cleaning. Standard departure cleaning is included in the quoted fee; excessive cleaning (e.g., smoke odor, stains, glitter/confetti, heavy grease) may incur extra charges.

10. Entry, Security & ID Verification

Keyless Entry. Guests receive a unique entry code valid from check-in to check-out. Keep the code confidential and report any compromise immediately so it can be reissued. Guest is responsible for losses stemming from shared/compromised codes.

Cameras. Exterior security cameras are installed (entryway, garage area, sides of house) for property protection and guest safety. No cameras inside the home and none facing the pool, spa, or lanai.

Identification. All registered guests must present government-issued photo ID at check-in (driver license, passport, or equivalent).

11. Weather, Hurricanes & Evacuations

No Weather Refunds. Weather is beyond the Host's control; no refunds for loss of use due to weather, including tropical storms/hurricanes, except as permitted under the applicable cancellation policy or required by law.

Storm Prep & Access. Guest agrees to cooperate and allow access for storm preparations when needed.

Evacuation Orders. If authorities issue a mandatory evacuation, Guest must comply and vacate promptly for safety. Unused nights are handled per the applicable cancellation policy and/or applicable law.

12. Condition, Damages & Pest Control

Walk-Through. At check-in, Host will provide a list of any known issues/defects. Guest must report any additional pre-existing damage immediately after walk-through. Unreported damage may be deemed to have occurred during the stay.

Guest Responsibility. Guest is responsible for preventable damage and negligence (including from unauthorized guests or vendors invited by Guest). Costs may be deducted from deposit or charged post-stay.

Pest Control. Property receives regular pest control inside and outside. Except for longer-term stays (2+ months), interior treatments are scheduled during vacant periods when possible. Occasional sightings of pests can occur in Florida; this is not grounds for cancellation.

13. Mail & Deliveries

No Post-Stay Forwarding. Host does not provide mail forwarding after departure. Guest should not use the property address for long-term mail.

Packages. Deliveries during the stay are at Guest's risk; Host is not responsible for lost or stolen items.

14. Legal Terms

Compliance. Guest shall comply with all applicable laws, ordinances, HOA/municipal rules, and this Agreement.

Assumption of Risk. Use of the home, dock, canal, pool, spa, stairs, and all amenities is at Guest's own risk.

Indemnification. Guest agrees to defend, indemnify, and hold harmless Host and its members, managers, and agents from claims, damages, fines, or costs arising out of Guest's (or invitees') use or breach of this Agreement.

Limitation of Liability. To the fullest extent permitted by law, Host shall not be liable for indirect, incidental, special, or consequential damages. Host's total liability, if any, shall not exceed the amounts actually paid by Guest for the stay in question.

Insurance. Guest is encouraged to purchase travel insurance and/or liability coverage.

Governing Law & Venue. Florida law governs. Venue for disputes is Lee County, Florida.

Booking Confirmation Incorporated. The booking confirmation, rental agreement, payment terms, cancellation policy, fees, deposits, taxes, and other written booking details provided by Host are incorporated by reference. In the event of a conflict regarding payments, fees, cancellations, refunds, deposits, or taxes, the booking confirmation or signed rental agreement controls.

Severability. If any provision is invalid, the remainder remains enforceable.

Entire Agreement. This is the entire agreement regarding the stay, supplemented by the booking confirmation and any signed rental agreement. No oral modifications. Changes require written approval by Host.

Acceptance & Effective Date

This Agreement is incorporated into and made part of every direct reservation for the Property. By submitting a reservation request, the Guest acknowledges these terms. A reservation is not confirmed until accepted by Host in writing and, if requested by Host, signed by Guest. The Agreement becomes effective on the date the booking is confirmed by Host and applies to the specific stay dates, occupants, and charges shown in the booking confirmation or rental agreement.
